Terms & Conditions
MJS Live Productions, LLC (“MJS Live,” “we,” “us”) is a Winston-Salem, NC-based video and photography production company serving businesses, nonprofits, and organizations across the Piedmont Triad. These Terms & Conditions govern every project booked with MJS Live, from event coverage and brand films to photography and drone video services. By signing a Statement of Work (SOW) or paying a deposit, the Client agrees to the terms below.
Scope of Services
MJS Live provides photography, photo editing, video production, video editing, drone coverage, and digital media consulting services as outlined in each project’s individual Statement of Work and Quote. Every engagement begins with a planning phase, including a Call Sheet and shot list/script, so both parties are aligned before any shoot day.
Payment Terms
- Projects over $500: A 50% deposit of the total project cost is due at signing to reserve the project date. This deposit is non-refundable. The remaining 50% is due under net-30 terms upon delivery of the rough-cut assets.
- Projects under $500: Full payment is due in advance of the project, prior to any shoot or delivery.
- Any pre-approved expenses or overages (travel, permitting, location fees, stock licensing, etc.) will be billed as part of the final invoice.
- All payments may be subject to a 5% administrative fee.
- Invoices not paid within 20 days of the due date may incur a 5% late fee, and MJS Live reserves the right to pause services or withhold final deliverables until payment is received in full.
Client Responsibilities — The Four P’s
To keep productions on schedule and on budget, clients are responsible for handling pre-production logistics — what we call the Four P’s: People, Place, Props, and Parking. This includes securing and preparing talent/subjects, confirming and preparing the shoot location, arranging any necessary props, and coordinating parking or site access for the crew. Clients who would prefer MJS Live to manage these logistics on their behalf may add pre-production coordination for an additional fee, outlined in the project’s Quote.
Additional client responsibilities include:
- Designating a single Client Project Manager (CPM) as the point of contact for approvals and scheduling
- Providing existing brand assets (logos, photos, footage) needed for the project, and granting MJS Live rights to use them within final deliverables
- Communicating shoot schedules at least 14 days in advance
- Responding to MJS Live requests and communications within 48 hours
- Crediting “MJS Live Productions” on delivered Assets wherever applicable
Delivery Timeline
- Photo selects (10–25 top images) are typically delivered within 24 hours of a shoot
- A full photo album is delivered within 7 days
- A rough cut of video projects (hero videos, commercial packages, etc.) is delivered within 30 days of the final shoot
- Files are stored in an accessible format (Google Drive, Frame.io, or similar) for at least 60 days post-delivery, with an internal MJS Live archive maintained for a minimum of one year
Ownership & Copyright
Clients own their final Assets outright once final payment is received. Upon receipt of full payment, the Client is granted exclusive, unlimited-use ownership of the finished Assets across all media platforms. MJS Live retains copyright ownership of all raw footage, raw photos, project files, and working materials from the production process, and reserves the right to showcase completed work — including brief clips, stills, or excerpts — in its portfolio, on social media, and in promotional materials. The Client grants MJS Live a non-exclusive, royalty-free license to use the Client’s name, logo, and likeness solely for that marketing purpose.
Cancellation & Rescheduling
Deposits are non-refundable and secure the project date. If a Client cancels:
- 8 or more days before the shoot date: Client owes 50% of the total project fee
- 7 or fewer days before the shoot date: Client owes 100% of the total project fee
- MJS Live may invoice for any work already performed or expenses incurred, regardless of cancellation timing
Rescheduling requests made at least 7 days before the shoot date are accommodated at no additional charge, subject to availability, with deposits carrying over to the new date. Requests made within 7 days of the shoot may incur a rescheduling fee to cover sunk costs. In cases of force majeure, both parties will work in good faith to reschedule; if that isn’t feasible, only actual costs incurred will be invoiced.
